Laut Bundesministerium für Gesundheit stirbt alle acht Stunden ein Mensch, der auf der Warteliste für Organspenden steht, weil kein passendes Spender-Organ gefunden wird. Die Zahl der Organspenden sank nach Angaben der Deutschen Stiftung Organtransplantation (DSO) in den vergangenen Jahren und erreichte 2017 ihren tiefsten Stand seit 20 Jahren. Seit 2018 steigen die Spenderzahlen wieder leicht. Um die Organspendebereitschaft zu erhöhen, hat der Deutsche Bundestag im Januar einige Neuerungen beschlossen. Anlässlich des Organspendetages am 6. Juni beleuchten die ARAG Experten die rechtliche Seite des Themas.

Gesetzliche Regelung
Jedes Land legt in seiner Gesetzgebung die Regelung zur Organ- und Gewebespende selbst fest. In Deutschland gilt die so genannte Entscheidungslösung. Dabei soll durch regelmäßige Information zum Thema Organspende eine bewusste Entscheidung zu Lebzeiten angeregt werden. Dazu erhalten alle Krankenversicherten, die das 16. Lebensjahr vollendet haben, alle zwei Jahre Informationsmaterial und einen Organspendeausweis von ihrer Krankenkasse. Bei dieser Lösung bleibt es auch weiterhin. Dies entschied der Bundestag am 16. Januar 2020. Die vom Bundesgesundheitsministerium vorgeschlagene sogenannte doppelte Widerspruchslösung fand dort keine Mehrheit.
