Unternehmen müssen im Rahmen einer Außenprüfung E-Mails mit steuerlichem Bezug vorlegen. Dies ergibt sich aus § 147 Abs. 6 Abgabenordnung (AO). Danach sind Handels- und Geschäftsbriefe, wozu auch E-Mails zählen, geordnet aufzubewahren und auf Verlangen vorzulegen. Das gilt sowohl für empfangene als auch für versendete E-Mails, sofern sie steuerlich relevant sind, zum Beispiel im Zusammenhang mit Verrechnungspreisen.
