Herr Klingelhöfer! Was ist eigentlich ein Mini-Job?
RA Tobias Klingelhöfer: Ein Mini-Job ist ein geringfügiges Beschäftigungsverhältnis. Das monatliche Arbeitsentgelt darf nicht mehr als 450 Euro betragen. Eine solche Teilzeitbeschäftigung ist weitgehend sozialversicherungsfrei.
Können Arbeitnehmer jederzeit zusätzlich zur regulären Erwerbstätigkeit einen Mini-Job annehmen?
RA Tobias Klingelhöfer: Es gibt natürlich Regeln. Unter Umständen muss der Hauptarbeitgeber von dem Vorhaben, eine Nebentätigkeit aufzunehmen, informiert werden. Und zwar immer dann, wenn das im Arbeitsvertrag oder Tarifvertrag vereinbart ist oder wenn der Nebenjob Auswirkungen auf den Hauptjob hat. Hat der Chef in diesem Fall triftige Gründe, kann er den Nebenjob untersagen.
