Die MMC Norilsk Nickel Group (im Folgenden „Norilsk Nickel“) gibt bekannt, dass das Unternehmen die Absicht hat, gegen die Regierung von Botswana in Bezug auf die Beteiligung am rücksichtslosen Handel von BCL Limited und BCL Investments Proprietary Limited (zusammen „BCL“) vorzugehen, im Hinblick auf die Rückforderung von USD 271 Mio. sowie Schadensersatz und andere Kosten, die sie Norilsk Nickel schuldet, sowie auch in Bezug auf den Verkauf einer 50 prozentigen Beteiligung an der Nkomati Mine in Südafrika (“ der Nkomati Deal „) und die USD 6,4 Mio., die sie Norilsk Nickel in Bezug auf den Verkauf der Tati Mine in Botswana schuldet. Die Regierung von Botswana ist der größte Aktionär der BCL durch ihr eigenes Unternehmen MDCB.

Die Bekanntmachung wurde gemäß Abschnitt 4 der Staatsvertragsverhandlung angereicht (zivilrechtliche Klage – von oder gegen die Regierung oder Beamte) Gesetz über dem Generalstaatsanwalt von Botswana, dem Minister für Mineralressourcen, umweltfreundliche Technologie und Energiesicherheit, und dem Finanzminister.
Norilsk Nickel vereinbarte im Oktober 2014 ihre Operationen in Afrika anzubieten und dass für einen Gesamtpreis von USD 337 Mio., obwohl der Betrag später reduziert wurde, als sich Norilsk Nickel zu einem Preiszugeständnis von BCL und der Regierung Einverstanden erklärt hat.
